Challenging a Will
Whether to “Challenge A Will”, is not something that should be taken lightly! It is not just a matter of how much you will get from an estate, because you are not happy with the deceased’s last wishes.
There are pros and cons that should be taken into account. Like how much impact it will have on your family life and that of other members of the family.
It can become very messy and lead to a life-long saga of disagreements and estrangements. However, if you feel that you have been “wronged” and want to go ahead with the Challenge for financial gain, you will need to show the Court that you are in financial need. Did the deceased have a moral obligation to provide for you in the Will and by not doing so, has it left you in financial need? In other words, were you dependent on the deceased?
